Terms & Agreement

In this Conditions:

 

“The Company” means Grout Pro-Tech LLP

 

“The Customer/ Owner/ Client" means the person or company who purchases the Services or Goods

 

“The Service” means any service Grout Pro-Tech LLP supplies to the Client under the Contract/ Agreement.

 

“The quotation” means the Company’s written quotation for the services or goods supply.

 

“the Agreement” means the contract for the provision of Service made between the Company and the Customer, including these Conditions

 

“The Goods/Materials” means any items, units, equipment, or other goods that Grout Pro-Tech LLP supplies to the Customer under or relating to an Agreement.

Covid-19 Measure

1.1 If the client or any household member is experiencing fever, flu, or cough, please report it to us immediately. For existing clients, please reschedule the project to prevent any unnecessary spread of COVID-19.


1.2 It is the client's full responsibility to be honest about their family's health status. Please inform any Grout Pro-Tech LLP employee if any household members are on Stay-Home Notice (SHN) or have had close contact with a confirmed COVID-19 case, as reported by MOH.

Grout Pro-Tech LLP will help you reschedule the project at no additional cost.


1.3 The client will be held responsible for any hidden or misleading information regarding health status.

Warranty Disclaimer

2.1 Grout Pro-Tech LLP offers a local warranty for workmanship starting from the balance due date after full payment. Services provided after the warranty period will incur additional charges.

 

  • Grout cement powder: 7 days.

  • Grout sealing services: 1 month.

  • Acrylic/Epoxy/Hybrid grout services: 2 years.

  • Polyaspartic grout service: 3 years.

  • Client-preferred brand: No warranty


2.2 The warranty covers tiles-to-tiles grouting only, addressing defects in grouting materials and installation at no additional cost, including transportation fees.


2.3 The warranty is strictly limited to tile joints and does not cover tiles connected to any other components, such as sanitary ware, furniture, piping, plastic, metal, silicon, marble, wood, etc.


2.4 The warranty does not cover repairs, touch-ups, tile replacements, goodwill adjustments, or additional services. Grout Pro-Tech LLP shall be compensated for transportation, labor, and any other miscellaneous fees if repairs are not covered.


2.5 Every warranty claim will be investigated and scheduled for repair according to Grout Pro-Tech LLP’s availability, which may take 2 weeks to 2 months during peak periods (e.g., year-end).


2.6 If damages are due to the user’s or any third party’s fault, reconfiguration, repair, willful constructional variations, modifications, or adjustments, the client will be charged for repair work and transportation fees, and the warranty will be voided based on the investigation result.


2.7 If it is determined to be a service quality issue, Grout Pro-Tech LLP will perform a corrective service at no additional charge within the warranty period. However, if the service was rendered according to BCA/industry standards or customer specifications, Grout Pro-Tech LLP expects full payment as per the contract/invoice.


2.8 The warranty covers services provided by Grout Pro-Tech LLP employees only. Any purchase of Grout Pro-Tech LLP materials installed by other companies' employees is not covered by any warranty. Clients are encouraged to seek advice from their installer, as workmanship quality may vary.


2.9 Should any contractor purchase Grout Pro-Tech LLP materials, the warranty covers material quality only, not workmanship. The material warranty is 6 months from purchase, provided it is unused and unopened.


2.10 We strongly advise that waterproofing, leakage or any defective issues be repaired by the client/contractor before the commencement of our services. Should the client choose to proceed without resolving such issues, grouting work may still proceed. Still, it will incur additional charges due to the extended duration, and no warranty will be provided for the affected area(s).

Quotation Validity period

3.1 Any quote is valid for one month from the date of the quotation. Quotations accepted after this period may require re-quoting.


3.2 Any changes in grout, tiles, area, or service conditions will require re-quoting, even within the quotation validity period.

4

Compensation

4.1 Completion: The project is considered complete and accepted by the client unless Grout Pro-Tech LLP receives written notice of any deficiencies within three (3) business days from the balance due date. A late payment fee (per Clauses 4.5 & 4.6) will apply if full payment is not received promptly.


4.2 Payment Terms: All deposits and payments must be made exclusively to Grout Pro-Tech LLP.


4.3 A deposit equivalent to 50% of the total job value is required for service confirmation, with the remaining balance due upon completion of the service, regardless of tile replacement status. Failure to make timely payments may result in late payment fees (per Clause 4.5).


4.4 Corporate Payment Terms: For corporate clients, the balance payment is due within 30 days of service completion. Failure to make timely payments may result in late payment fees (per Clause 4.6).


4.5 Late Payment Fee: Any payment past the due date will incur a $100 late fee within the first month. Late payment fees will be charged at a rate of 1.5% of the total project billed per month starting from the 2nd month onwards.


4.6 For corporate clients, late payment fees will be charged at a rate of 2% per month of the total project billed starting from the 2nd month onwards, up to a maximum of 100% of the total project value.


4.7 For individual clients, payment is due upon the balance due date. The client should either show our technicians proof of payment via PayNow or Bank Transfer for the invoiced amount or provide a cheque/cash/PayNow payment for the amount specified on the invoice. Our technicians will take a photo of the payment as evidence to facilitate transaction verification.


4.8 For corporate clients, proof of payment for the invoiced amount, or a cheque/cash/PayNow payment for the amount specified on the invoice, should be sent to Grout Pro-Tech LLP via email, WhatsApp (using the mobile number stated on the invoice), or mail.


4.9 Grout Pro-Tech LLP reserves the right to halt service and keep the project idle if due deposits/payments are not made in a timely manner. If the service is halted for this reason for more than 3 days without due payments being made, the Client shall be deemed at fault. Grout Pro-Tech LLP may then make a final demand for all payments due, including any additional expenditures for services performed, materials ordered or supplied, or any other loss sustained.

4.10 If payment is not made within 5 working days thereafter, Grout Pro-Tech LLP will be entitled to all legal remedies for breach of this project contract and will demand full project value/payment due.

Cancellation & Reschedule Policy

5.1 For all services provided by Grout Pro-Tech LLP, cancellation must be notified at least 1 month before the scheduled date for a full refund of the 50% deposit. For cancellations after, the 50% deposit will be non-refundable.


5.2 Rescheduling due to COVID-19 with proof of a positive test will incur no additional charges (per Clause 1.2).


5.3 For project rescheduling, please inform us 2 weeks in advance so we can allocate the slot for other projects. If the rescheduled date is within 2 weeks before the project starts, it will incur a rescheduling/cancellation fee of $100 before GST.


5.4 Rescheduling due to leakage, defective issues, or tile replacement by the client will incur additional charges (1.5% of the total project value before GST per month delayed) due to the prolonged service. The new rescheduling date and time will be determined and scheduled according to Grout Pro-Tech LLP’s availability.

6

Change Order

6.1 Additional fees and project delays will be incurred for alterations to color/area selection after the project confirmation date, changes in the scope of service, services requested beyond standard operating hours, services required outside of the invoice, rescheduling more than twice, inability to access premises/areas within 1 hour, or disruptions in service.


6.2 All proposed changes must be requested in writing, including at least the following information: proposal date, the change requested, an explanation of how it will affect the cost or time of completion, the scope of service, and acknowledgment by the proposing party. Once both parties have acknowledged their approval, the proposal will be designated as a “Change Order” and incorporated into the service.


6.3 For all services provided by Grout Pro-Tech LLP, any schedule changes must be notified at least 2 weeks ahead, and reschedule limits capped at 2 times. In the event the new rescheduled date is eventually canceled, then the cancellation fee outlined above will apply (causes 5.3).


6.4 The grout color must be confirmed before the project's scheduled date. Once the color has been confirmed, no changes during or after the project are permitted. If the client insists on a change (per Clause 6.1), Grout Pro-Tech LLP will charge for the redo, and the project will be rescheduled (per Clause 8.2) based on Grout Pro-Tech LLP’s availability.

7

Liabilities & Quality Control

7.1 Grout Pro-Tech LLP provides work injury compensation for all its workers, as laid out in the Work Injury Compensation Act (WICA), and medical insurance.


7.2 Grout Pro-Tech LLP’s liability for all other loss or damage suffered by the Client in any one week, caused by an act or omission of Grout Pro-Tech LLP or its employees, shall not exceed 100% of the value of the appointment during which the damage was caused, or $1,000, whichever is lower.


7.3 Grout Pro-Tech LLP shall not be liable for any loss of profits, indirect, consequential, or special loss or damage, howsoever caused, arising from the Client’s use or possession of the goods or benefits from the services provided by Grout Pro-Tech LLP.


7.4 The Client will pay for any damaged or missing equipment belonging to Grout Pro-Tech LLP if it is taken from the client’s property.​


7.5 The Client's use of the service is at its own sole risk. The service is provided on an "As is" or "As available" basis. The client should expect dirt/mold to sit on newly laid grout if not cleaned with a household cleaning agent but rather premium material to inhibit the absorption of dirt/ mold/ liquid. Should a repair be scheduled based on the above issue, Grout Pro-tech LLP will be compensated for an investigation fee of SGD$100 before GST per visit.

7.6 Standardized Work: Grout Pro-Tech LLP strives for excellent workmanship and consistency in accordance with the Building and Construction Authority's (BCA) guidelines. However, the client acknowledges that Grout Pro-Tech LLP shall not be held liable for any unlevelled or uneven grout lines caused by existing client tiles, slower drying times, or workmanship flaws that are only visible under the spotlight or specific lighting conditions.

8

Additional Provisions

8.1 Schedule: Grout Pro-Tech LLP services will be scheduled based on availability, including any pending or touch-up service. Standard operations are from Monday to Friday between 0900 and 1700, excluding public holidays.


8.2 The Client must provide Grout Pro-Tech LLP with access on the scheduled dates. If the installation team arrives at the scheduled time and is unable to access the service area within an hour, a rescheduling fee ( causes 5.3) will be applied. It will be rescheduled to a later date based on Grout Pro-Tech LLP availability.


8.3 Permits: The Client will obtain, at its own cost, all necessary permits and permissions to perform the service required for the Construction Project. Should permit or Grout Pro-Tech be rejected access area on the scheduled date for whatsoever reason, a rescheduling fee (causes 8.2) will be applied.


8.4 Access: Clients are required to provide safe access to premises/areas as reasonably necessary for Grout Pro-Tech LLP to perform services. No additional work/personnel should be conducted within the service area throughout the project duration.


8.5 Permissions: Grout Pro-Tech LLP is allowed to display the Client service area as part of its client portfolio/marketing purposes, progress documentation, and warranty unless stated before the service/project confirmation/ invoice date.

Project Contract

9.1 If the Service involves a bathroom / wet area, The Client must make sure the area is left dry overnight (minimum of 6 hours). If the area is wet and Grout Pro-Tech LLP is unable to start work, Grout Pro-Tech LLP reserves the right to reschedule the project, and a rescheduling fee (causes 5.3) will be applied.​


9.2 The client is responsible for providing electricity during the project, and for ensuring that other contractors, family members, children, and pets do not interfere with the project’s progress.


9.3 During the course of service on the Construction Project, The Client may have access to the service area for purposes of inspection/appraisal, and service evaluation. Such access and inspections will be conducted at reasonable times, with advance notice to Grout Pro-Tech LLP when reasonably practicable, and in a manner not to obstruct the progress of service. There will be no photo/video taking of our work in progress or employees. If any interference happens, Grout Pro-Tech LLP will have the right to stop all services immediately, and a rescheduling fee (causes 5.3) will apply.


9.4 At the handover of the project, the Client or an individual over 18 years old representative of the client must be present to have a round of site walk with the Grout Pro-Tech LLP representative. Should The Client choose not to be present on the last date of the project for handover, it will be deemed as default completed. Once the project is completed, it is considered complete and the balance payment will be due.


9.5 Project/ Service shall mean the service that Grout Pro-Tech LLP is obligated to perform for the client as detailed on the Project Contract form or invoice stated. Any add-on service requested is chargeable and not in warranty. A rescheduling fee may apply if the requested work prolongs the service duration.

9.6 Grout Pro-Tech LLP reserves the right to modify or change the terms without any prior notice. If any provision of these terms is held to be invalid or unenforceable by the court, the remaining terms shall remain in effect.


9.7 Grout Pro-Tech LLP strongly advises all clients to read carefully the full terms and conditions before engaging with any Grout Pro-Tech LLP services/purchase. In any wistful event, the client shall bear full responsibility or cost.


9.8 If the Client does not agree with these terms at any point in time, all service will be kept idle. This does not cover the payment due amount and the Client will be billed as per invoice.

10

Jurisdiction

10.1 Governing Law: The interpretation of these terms and agreements will be governed by Singapore Law, and any disputes that arise shall be under the exclusive jurisdiction of the Republic of Singapore's courts.


10.2 Grout Pro-Tech LLP will not be deemed in breach of this Construction Contract or have liability to the Client for failure to perform obligations under this Project Contract if the failure is due in whole or in substantial part to strikes, acts of God, unavailability of specified labor or materials, war, acts of terror, or other causes beyond the reasonable control of Grout Pro-Tech LLP.


10.3 Grout Pro-Tech LLP strongly advises all clients to read the full terms and conditions before engaging in any Grout Pro-Tech LLP services/purchases.
Any use of The Service/ Purchases from Grout Pro-Tech LLP is on condition of The Client's acceptance and compliance with these terms.


10.4 The terms and conditions set by Grout Pro-Tech LLP must be adhered to strictly in their entirety, and the Client must fulfill their responsibilities as stated.
